LEGAL DISCLAIMER INTERPRETATION
"user" a person who uses and/or accesses the content of the NEWSTODAY website
"software" including, but not limited to, any content - whether data or programmes - on the website
"data" including, but not limited to, text, images, audio and/or video
"content" included, but not limited to, software and data;
"NEWSTODAY sites" all the sites on the internet controlled and/or owned by the NEWSTODAY
"submissions" including but not limited to notes, images, creative data, ideas, suggestions concepts, communication including any data, questions, comments and other information submitted in the NEWSTODAY sites via transmission by electronic mail or otherwise
"forums" including but not limited to bulletin boards, chat-rooms and other public areas found on the NEWSTODAY sites

TRADE MARK / COPYRIGHTS AND RESTRICTIONS ON USE
1. The sites consist of contents which are derived entirely or in part from content supplied by the NEWSTODAY and other sources. The contents are protected under applicable South African laws and conventions.
2. The user may not reproduce any of the contents, that being software and/or data. The user may download one copy of the content for non-commercial home use, but all notices and restrictions attached to the content must be kept intact. This restriction is always in effect, unless expressly permitted by the site, or unless prior written consent from NEWSTODAY has been obtained. 3. The user is also prohibited from creating works and/or software derived from the contents on the NEWSTODAY website.

ACCESS AND AVAILABILITY OF SERVICE AND LINKS
1. The NEWSTODAY websites contains links to other internet sites. NEWSTODAY is not connected with, does not operate or control these sites. Whether or not these linked sites are in fact affiliated with the NEWSTODAY, NEWSTODAY is not responsible for the content on the links. The linked sites are for the user's convenience only and the user access to these is at the user's own risk.
2. When visiting linked sites, the user must refer to the linked sites' terms of use.

SUBMISSIONS / BULLETIN BOARDS
1. Any submissions shall be deemed to be and remain the exclusive property of NEWSTODAY. The forums' content remains the exclusive property of NEWSTODAY.
2. NEWSTODAY has the right, but not the obligation to monitor and review submissions submitted by users. NEWSTODAY is not responsible for any of the content of these messages. NEWSTODAY further reserves the right to delete, move or edit objectionable submissions.

RULES OF CONDUCT FOR THE USER
The user agrees that he/she will not transmit submissions to the NEWSTODAY sites that:
1. Are unlawful, threatening, abusive, defamatory, obscene, vulgar, profane, pornographic and/or allow for indecent information that constitutes a criminal offence and/or gives rise to a civil liability claim or otherwise violates any local, national or international law;
2. Restrict or inhibit any other user from using and enjoying the forums;
3. Are for purpose of spamming;
4. Contain viruses or other harmful contents;
5. Are intended for commercial purposes, contain marketing or promotional data or are intended to solicit donations.
The user, by the transmission of content, represents to NEWSTODAY that they are the rightful owner of such content or has obtained permission from the rightful owners to submit such content;
The user agrees that all submissions become the exclusive property of the NEWSTODAY. The user agrees that he/she is solely liable for any damage resulting from such a submission. The user further indemnifies NEWSTODAY against all claims for any damages whatsoever arising from the use of the NEWSTODAY sites.

DAMAGES, WARRANTY, INDEMNITY
1. The user expressly agrees that the use of the NEWSTODAY site is at the user's sole risk. NEWSTODAY does not guarantee or warrant;
* that the NEWSTODAY sites will be uninterrupted;
* that the NEWSTODAY sites will be default free and that the defects will be corrected;
* the results that may be obtained from information gained from the NEWSTODAY sites in so far as accuracy and content of any such information is concerned;
2. These sites are without warranty of any kind, including, but not limited, to warranties of satisfactory quality, non- infringement, title, security and compatibility.
3. The user acknowledges and confirms NEWSTODAY indemnity to damages arising from the use of, or inability to use, NEWSTODAY sites.
4. If any of the terms and conditions of this agreement should be deemed to be unlawful, invalid or otherwise unenforceable, it shall be severed and deleted from the agreement and the remaining terms and conditions remain in full force.

GENERAL
1. This agreement, the terms, conditions and operating rules for the NEWSTODAY sites, constitute the entire agreement between the parties. The agreement and the terms and conditions shall be governed and construed in accordance with the laws of the Republic of South Africa. Any dispute arising here from shall be exclusively subject to the jurisdiction of the courts and/or tribunals of the Republic of South Africa.
2. NEWSTODAY may revise these terms and conditions. The user is bound by revisions and should periodically visit this agreement to review the current terms and conditions.
3. NEWSTODAY has the exclusive right to at any time change or discontinue any aspect or feature of the NEWSTODAY sites.

AGREEMENT TO AND TERMINATION OF AGREEMENT
1. The use of or access to these sites constitutes the users acceptance of the terms and conditions.
2. If the user does not accept all the terms and conditions in full, the user must exit the site immediately.
3. The user must destroy all content, whether data or software, obtained from the site and all copies thereof upon exit.
4. In the event of the user failing to exit the site as aforesaid, NEWSTODAY has the right to claim any damages caused to NEWSTODAY from the user's unauthorized access and/or use of the NEWSTODAY sites.
5. The user further indemnifies NEWSTODAY against any claims for damages of whatsoever nature caused to another party by the user's unauthorized use and/or access of the sites.
